1. Agreement to Terms

By accessing or using Free Vintage Illustrations ("the Service") operated by Free Vintage Illustrations ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

3. User Accounts

Account Creation

Account Termination

4. Intellectual Property Rights

Content Ownership

The vintage illustrations in our library are either in the public domain or licensed for distribution. However, our curation, organization, enhancements, and presentation of these materials are protected by copyright and other intellectual property rights.

License Grant

Subject to these Terms and your subscription level, we grant you a limited, non-exclusive, non-transferable license to:

• Download and use illustrations according to your subscription plan
• Create derivative works for personal or commercial use (based on plan)
• Use illustrations in accordance with the specific license terms

Restrictions

You may not:

• Resell or redistribute the illustrations as standalone files
• Create competing illustration libraries or services
• Use automated systems to bulk download content
• Remove or alter any copyright or attribution notices
• Use illustrations in a way that infringes on third-party rights

5. User Content

Your Designs and Remixes

When you create custom designs or remixes using our tools, you retain ownership of your creative contributions. However, you grant us a license to:

• Store and display your designs within your account
• Process your designs for printing or download
• Include anonymized usage data in our analytics

Public Sharing

If you choose to share your designs publicly, you grant us a worldwide, non-exclusive license to display, distribute, and promote your content across our platform and marketing materials.

6. Subscription Plans and Billing

Subscription Terms

We offer various subscription plans with different features and download limits:

• Free Plan: Limited downloads per month
• Basic Plan: Increased download limits
• Pro Plan: Unlimited downloads and commercial use
• Enterprise Plan: Custom solutions for businesses

Billing and Renewal

Paid subscriptions are billed in advance on a monthly or annual basis and are non-refundable. Your subscription will automatically renew unless you cancel it before the renewal date.

Price Changes

We reserve the right to change subscription prices with 30 days' notice. Price changes will take effect at your next renewal period.

7. Merchandise and Physical Products

Print-on-Demand Services

We offer print-on-demand merchandise featuring vintage illustrations. Orders are fulfilled by third-party partners (such as Printful) and are subject to their production and shipping times.

Returns and Refunds

For physical products:

• Defective or damaged items may be returned within 30 days
• Custom/personalized items are non-returnable unless defective
• Shipping costs for returns are the customer's responsibility unless the item is defective
• Refunds are processed within 5-10 business days of receiving the return

8. Prohibited Uses

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or viruses
• Engage in unauthorized data mining or scraping
• Harass, abuse, or harm other users
• Create multiple accounts to exceed download limits
• Attempt to gain unauthorized access to our systems
• Use the Service for any illegal or unauthorized purpose

9. Privacy

10. Disclaimers and Limitations of Liability

Service Availability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Content Accuracy

While we strive to provide accurate information about the provenance and copyright status of illustrations, we cannot guarantee the accuracy of all metadata and recommend conducting your own due diligence for commercial use.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

11. Indemnification

You agree to indemnify, defend, and hold harmless Free Vintage Illustrations and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Dispute Resolution

Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

Class Action Waiver

You agree to bring claims against us only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
